Terms of Service

1. Acceptance of Terms

By accessing or using the Birtour platform, website, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services.

2. Description of Services

Birtour provides a technology platform for travel agencies to manage their operations, including but not limited to:

  • Hotel and flight booking management
  • Tour package creation and distribution
  • Client relationship management
  • Itinerary planning and scheduling tools
  • Agency performance analytics and reporting

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using the Services on behalf of a business, you represent that you have the authority to bind that entity to these Terms.

3.2 Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate, current, and complete information
  • Notifying us immediately of any unauthorized access

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful or fraudulent purpose
  • Violate any applicable laws, regulations, or third-party rights
  • Transmit harmful code, malware, or viruses
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Services
  • Scrape, harvest, or collect data without authorization
  • Misrepresent your identity or affiliation

5. Booking & Reservation Terms

5.1 Agency Responsibility

As a travel agency using Birtour, you acknowledge that you are responsible for the accuracy of all booking information submitted, including passenger details, travel dates, and special requirements.

5.2 Supplier Relationships

Birtour facilitates connections between travel agencies and suppliers (hotels, airlines, tour operators). We are not a party to the contracts between agencies and suppliers. Terms, pricing, and conditions of bookings are governed by the respective supplier's policies.

5.3 Cancellations & Modifications

Cancellation and modification policies vary by supplier. You are responsible for understanding and communicating these policies to your end clients. Any fees associated with cancellations or modifications are your responsibility.

6. Fees & Payment

6.1 Subscription Fees

Access to certain features of the Services may require a paid subscription. Fees are outlined on our pricing page and may be updated periodically with advance notice.

6.2 Payment Terms

  • Fees are billed in advance on a monthly or annual basis
  • All payments are non-refundable unless otherwise stated
  • We reserve the right to suspend accounts with overdue payments
  • Applicable taxes are your responsibility

7. Intellectual Property

7.1 Our Rights

All content, features, functionality, trademarks, and branding of the Birtour platform are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7.2 Your Content

You retain ownership of content you submit through the Services. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process that content solely for the purpose of providing the Services.

8. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

  • The Services will be uninterrupted, secure, or error-free
  • Results obtained from the Services will be accurate or reliable
  • Any defects will be corrected in a timely manner

10. Limitation of Liability

To the maximum extent permitted by law, Birtour and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services.

11. Indemnification

You agree to indemnify and hold harmless Birtour and its affiliates from any claims, liabilities, damages, losses, and expenses arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination will remain in effect.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Azerbaijan, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Baku, Azerbaijan.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the platform or via email. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
